Confirm that Level 1 has been passed and whether the application covers one or both categories, complete onboarding, recheck the resource-book edition, request adjustments at least two weeks in advance and do not treat written exam preparation as a substitute for live advocacy training.

Common IAA L3 Immigration questions

Is this an official IAA course or question bank?

No. This is an independent syllabus-mapped study guide. Current IAA guidance, the assessment invitation, resource book, live law, Code and formal authorisation control.

What is the current Level 3 Immigration assessment structure?

It is a 180-minute online proctored paper containing scenario-based questions that require typed written answers. The pass mark is 65%. IAA does not publish a fixed current question or mark total.

Does the May 2024 sample define the current paper?

No. Its twelve questions, 80 marks and three-hour limit illustrate written task styles such as advice letters and skeleton arguments. Its law and fixed totals are historical.

Does the written assessment test live oral advocacy?

No. It can test advocacy judgment, procedure and written work, but it does not reproduce a hearing. An adviser representing at a hearing must separately possess sufficient verbal and written advocacy competence.

How is a borderline paper handled?

A score from 60% through 68% is reassessed by a second independent marker. Scores outside that band are not automatically remarked.

Must I pass Level 1 before Level 3 Immigration?

Yes. Current consolidated guidance requires applicants seeking Level 2 or Level 3 in the Immigration category to pass the Level 1 Immigration assessment first.

If I apply in both categories, which paper will I sit?

IAA selects either Immigration or Asylum and Protection on the assessment day without advance notice, so applicants seeking both must prepare both.

What may I use in the open-book assessment?

Hard-copy books and notes may be kept within camera view. Internet access is prohibited except for the official resource book supplied in the assessment environment.

Which law date controls the current resource book?

The current May 2026 Levels 2 and 3 resource book contains law as at 30 April 2026. IAA says current assessment questions are based on the law contained in that book.

Why does the 2025 syllabus mention temporary admission?

That phrase remains in the asylum-awareness part of the published PDF. Treat it as a syllabus signpost; use current resource-book law for the assessment and live GOV.UK sources for practice.

What specialist work is permitted at Level 3 Immigration?

It includes all lower-level Immigration work, specialist cases, complex appeals, full First-tier and Upper Tribunal preparation and representation, bail hearings, instruction of counsel and permitted PAP drafting.

Does Immigration authorisation cover asylum casework?

No. The syllabus requires asylum and protection awareness, but substantive work requires the adviser and organisation to hold the Asylum and Protection category at the appropriate level.

What advocacy work is permitted?

Within the Immigration category, Level 3 includes full grounds, evidence, witness preparation, bundles, skeleton arguments, substantive appeal conduct and representation before the First-tier and Upper Tribunal.

Can Level 3 conduct First-tier Tribunal bail?

Yes, for a case covered by the adviser's Level 3 category and competence. Detention authority, vulnerability, release planning and any parallel remedy still require separate analysis.

Can Level 3 draft a Judicial Review PAP letter?

Yes. Current consolidated guidance lists PAP drafting as Level 3 work. That does not authorise the adviser to lodge or litigate Judicial Review.

What additional authority is needed for Judicial Review?

Judicial Review case management requires separate JRCM authorisation plus Level 3 authorisation in the underlying category. Appropriately licensed counsel must undertake every formal litigation and advocacy step.

Can an IAA adviser appear as a McKenzie Friend?

No. The competence guidance states that IAA advisers must not seek to appear as McKenzie Friends in relation to immigration matters.

What experience and training are expected?

The current guide expects at least 18 months' full-time-equivalent UK immigration-advice experience, including six months of Level 3 work, plus current training across every area sought.

How can IAAS accreditation affect Level 3 Immigration?

IAAS accreditation does not create a general Immigration-category exemption. Current guidance says a Senior or Supervisor Senior Caseworker who holds or obtains IAA Level 2 Immigration need not take the Level 3 Immigration assessment to extend to Level 3, subject to evidence and conditions.

Does passing the paper authorise advocacy?

No. The assessment is one part of the application. The adviser and organisation must wait for formal Level 3 Immigration authorisation, and separate JRCM approval where applicable.

Are the four section percentages official IAA weights?

No. IAA publishes ten syllabus headings but no scored distribution. The four sections and twelve topics are stable Pass Harbor study mappings only.
