Common IAA L3 Asylum & Protection questions

Is this an official IAA course?

No. This is an independent syllabus-mapped study guide. Current IAA guidance, the assessment invitation, resource book, live law, Code and formal authorisation control.

What is the current Level 3 assessment structure?

It is a 180-minute online proctored paper containing scenario-based questions that require typed written answers. The pass mark is 65%. IAA does not publish a fixed current question or mark total.

Does the May 2019 sample define the current paper?

No. Its twelve questions, 81 marks and three-hour limit illustrate written task style only. Its law and fixed totals are historical.

Does the written assessment test live oral advocacy?

No. It can test advocacy judgment and written work, but it does not reproduce a hearing. An adviser representing at a hearing must separately possess sufficient verbal and written advocacy competence.

How is a borderline paper handled?

A score from 60% through 68% is reassessed by a second independent marker. Scores outside that band are not automatically remarked.

If I apply in both categories, which paper will I sit?

IAA selects either Immigration or Asylum and Protection on the assessment day without advance notice, so applicants seeking both must prepare both.

Must an Asylum and Protection applicant pass Level 1 first?

No Level 1 assessment exists in the Asylum and Protection category. The current Level 1-first requirement applies to higher-level Immigration applicants.

Which law date controls the current resource book?

The current May 2026 Levels 2 and 3 resource book contains law as at 30 April 2026. IAA says current assessment questions are based on the law contained in that book.

Why does the 2025 syllabus contain obsolete terms?

The attached PDF retains historical labels such as Tiers 1-5, A8 and A2, old EEA residence documents, NASS and temporary admission. They remain syllabus signposts, but current resource-book law controls the assessment and live GOV.UK sources control practice.

What advocacy work is permitted at Level 3?

Within an authorised category, Level 3 includes full First-tier and Upper Tribunal preparation, grounds, evidence, skeleton arguments, substantive appeal work, hearing representation and instruction of counsel through an applicable access scheme.

Can Level 3 conduct First-tier Tribunal bail?

Yes, for a case covered by the adviser's Level 3 category and competence. Detention authority, vulnerability, release planning and parallel remedies still require careful analysis.

Can Level 3 draft a Judicial Review PAP letter?

Yes. Current consolidated guidance lists PAP drafting as Level 3 work. That does not authorise the adviser to lodge or litigate Judicial Review.

What additional authority is needed for Judicial Review?

Judicial Review case management requires separate JRCM authorisation plus Level 3 authorisation in the underlying category. Appropriately licensed counsel must undertake every formal litigation and advocacy step.

Can an IAA adviser appear as a McKenzie Friend?

No. The competence guidance states that IAA advisers must not seek to appear as McKenzie Friends in relation to immigration matters.

Is family reunion currently available?

The syllabus and competence guidance retain family-reunion knowledge, but the consolidated guide updated 28 July 2026 marks the route as currently suspended. Recheck live Rules and guidance.

What experience and training are expected?

The current guide expects at least 18 months' full-time-equivalent UK immigration-advice experience, including six months of Level 3 work, plus current training across every area sought.

Does IAAS accreditation create an assessment exemption?

Prospective advisers who passed IAAS Senior Caseworker or Supervisor Senior Caseworker examinations may be exempt from IAA Level 1-3 Asylum and Protection assessments if they provide the required evidence and meet current conditions.

Does passing the paper authorise advocacy?

No. The assessment is one part of the application. The adviser and organisation must wait for formal Level 3 authorisation in Asylum and Protection, and separate JRCM approval where applicable.

Why are there six sections when the syllabus has twelve headings?

The six sections are stable local practice groups already used by the 601-item bank. The twelve published headings are recorded in the assessment basis. Neither grouping implies official scored weights.
