How to study for the APLH assessment

Build the licensing structure first, then practise separating people, premises, permissions, duties, offences, exceptions and authority powers.

Core concepts

Concept 1

A holder charged with a relevant offence must produce the personal licence to the court by the required first appearance or notify the court of the licence and explain why production is impracticable.

Exam cue: Match the event to the recipient: court, relevant licensing authority, police or authorised officer.

Concept 2

Changes of name or address must be notified to the relevant licensing authority as soon as reasonably practicable, using the statutory process.

Exam cue: Do not postpone a notification merely because the holder is no longer working at the premises where alcohol was sold.

Concept 3

The Act provides duties and consequences for convictions, lost or damaged licences, surrender, production to authorised officials and later suspension, revocation or forfeiture decisions.

Exam cue: Separate the criminal court's powers from the licensing authority's later power to suspend or revoke.

Risk pitfalls and guardrails

Assuming the employer or DPS can make every personal notification on the holder's behalf.

Guardrail: Do not rely on former renewal rules, temporary TEN limits, Scottish licensing law, informal workplace custom or a broad exception where the statute is narrow.

Waiting until licence renewal to report a name or address change when renewal is no longer required.

Guardrail: Do not rely on former renewal rules, temporary TEN limits, Scottish licensing law, informal workplace custom or a broad exception where the statute is narrow.

Treating a drink-driving conviction as irrelevant without checking the relevant-offence and notification provisions.

Guardrail: Do not rely on former renewal rules, temporary TEN limits, Scottish licensing law, informal workplace custom or a broad exception where the statute is narrow.

Memory anchors

Charged with a Relevant Offence

Produce the personal licence to the court by the required appearance or notify the court and explain why it cannot be produced.

Name or Address Change

Notify the relevant licensing authority as soon as reasonably practicable and follow the prescribed replacement process.

Lost, Stolen or Damaged

Use the issuing authority's statutory replacement route; loss or theft may also require a police report.

Produce on Lawful Request

A holder must be ready to produce the licence to a constable or authorised officer where the Act permits a request.

Court Consequences

On conviction for a relevant offence, a court may order forfeiture or suspension of the personal licence.

Authority Consequences

The licensing authority also has statutory power to suspend or revoke in qualifying conviction or immigration-penalty cases.

Checkpoint rule

Do the check-up only after you can summarize each concept in one sentence and identify one dangerous pitfall from memory.

Knowledge Check (after reading)
