Core concepts
Concept 1
Capacity and legal personality determine who can own assets or enter arrangements; powers of attorney and agency determine who may act and within what authority.
Exam cue: Identify the legal person, capacity, ownership and source of authority before analysing a transaction.
Concept 2
Contract formation, terms, misrepresentation, discharge and remedies interact with agency and ownership when identifying rights and responsibilities.
Exam cue: Separate legal title, beneficial interest and an agent's power to act.
Concept 3
Bankruptcy, insolvency, wills, intestacy and trusts alter control, beneficial ownership, creditor exposure and the destination of assets.
Exam cue: For death or insolvency, trace which assets enter an estate or insolvency process and which rules govern them.
