Core concepts
Concept 1
Qualifying wholesale transactions may fall outside retail sale only when the seller, premises, off-premises consumption and buyer-purpose conditions in section 192 are met.
Exam cue: For wholesale, identify the buyer and business purpose as well as ownership or occupation of the selling premises.
Concept 2
Schedule 1 defines regulated entertainment and its exemptions, while Schedule 2 defines late-night refreshment and its exclusions; labels such as music, private event or charity do not decide the issue alone.
Exam cue: For entertainment or refreshment, check audience, purpose, time, location, scale and the exact statutory exemption.
Concept 3
Alcohol may not be sold on a moving vehicle, while railway vehicles and aircraft on journeys have specific exemptions and stationary mobile premises require an authorisation for the place of sale.
Exam cue: For vehicles, decide whether the vehicle is moving, parked, a railway vehicle or aircraft on a journey, and where the alcohol is appropriated to the contract.

Wholesale Test
A non-retail sale must satisfy the statutory premises, off-consumption, buyer and trade-purpose conditions.
Retail Location
For remote sales, the licensable sale is generally treated as taking place where the alcohol is appropriated to the contract.
Entertainment Test
Use Schedule 1 and current exemptions; the event's label alone does not determine whether entertainment is regulated.
Late-Night Refreshment
Supplying hot food or hot drink to the public between 23:00 and 05:00 is licensable unless an exemption applies.
Moving Vehicle
Alcohol cannot be sold on a moving vehicle; a parked mobile bar needs authority for the place where sales occur.
Excluded Premises
Motorway service areas and premises used primarily as garages are subject to the statutory alcohol-sales prohibition.
